Acquisition Hour: Office of Federal Contract Compliance Programs (OFCCP) Compliance 101

Many businesses are not aware that when their company becomes a federal contractor and/or subcontractor, that they have 120 days from the signing of the federal contract to develop a written Affirmative Action Program (AAP). Not knowing could cost you time and money. It is never pleasant to discover this after you receive notice of an OFCCP (Office of Federal Contract Compliance Programs) audit. Non-compliance with the AAP requirement is about to become an even more serious problem as OFCCP embarks on the planned AAP Verification Initiative this year where all federal contractors and subcontractors must certify online on an annual basis that they have developed and are maintaining an Affirmative Action Program.
As an HR professional or contract administrator, you may not be aware of the certifications and attestations someone at your company has already made regarding the presence or absence of an AAP when it registered to do business with the federal government.
This requirement also applies to Subcontractors with purchase orders of $50,000 or more with a federal contractor.
