Notice on updated Regulations for Construction Contracts with the State of Wisconsin Department of Administration: The 2015-17 Wisconsin State Budget (2015 Wisconsin Act 55) modified Wisconsin’s prevailing wage laws. Effective January 1, 2017, the administration of state prevailing wage on state building projects will transition from the Department of Workforce Development (DWD) to the Department of Administration/ Division of Facilities Development (DOA/DFD). Prevailing hours of labor will be determined by Wis. Stats. 16.856(1)(e) and prevailing wage rates will be as determined by the U.S. Department of Labor 40 U.S.C. 3142 for publication in the applicable project bidding documents. Please access the DOA Prevailing Wage web page for more information about how prevailing wage rates will be applied to state building projects.
The 2013-15 Wisconsin State Budget (2013 Wisconsin Act 20) significantly altered the bidding and contracting processes for state construction projects. In summary, it created a mandatory pre-bid contractor certification program and required that all projects over $185,000 are let through single prime bidding and contracting. Under the new laws, all potential bidders must become certified by the Wisconsin Department of Administration (DOA) prior to submitting bids. All bids received from contractors who are not certified will be rejected. Please access the DFD Contractor Certification web page to apply for certification. Please access the DFD Single Prime Bidding and Contracting web page for more information about how projects will be let under the new system.
