In accordance with the authority in DoD Directive (DoDD) 5135.02, the guidance in DoD Instruction (DoDI) 5010.44, and pursuant to Sections 130, 1707, and 3771 through 3791(b) of Title 10, United States Code (U.S.C.), this issuance:
Assigns responsibilities and provides procedures for the acquisition, delivery, receipt, inspection, acceptance, and management of contractor-prepared data and associated data rights for contracts and where appropriate, other non-Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) agreements (e.g., other transaction agreements).

U.S. Department of War: Acquisition Transformation Strategy
The Department of War (DOW) is rapidly transforming our antiquated acquisition processes and revitalizing the atrophied Defense Industrial Base (DIB) by prioritizing speed, flexibility, and rigorous execution. The Secretary of War has placed the Department on a war footing, and the Warfighting Acquisition System (WAS) is aligning with urgency and velocity, balancing speed with rigor in execution to ensure we rapidly deliver relevant and effective solutions at scale to address warfighting needs. Executive Order (E.O.) 14265, Modernizing Defense Acquisitions and Spurring Innovation in the Industrial Base, directed the Department to prepare this strategy, consistent with President Trump’s direction to transform the current defense acquisition system to ensure delivery of capabilities to the American warfighter at pace to deter and, if necessary, defeat our adversaries.

Rebuilding our military and reestablishing credible deterrence demands the Department of War (DoW) put our Acquisition System and Enterprise on a wartime footing and dramatically accelerate the fielding of new technology and advanced capabilities to maintain the military superiority of our Armed Forces. To drive urgency and achieve acceleration, we recently transformed the way military requirements are developed, and now direct the transformation of the Defense Acquisition System (DAS), in accordance with Executive Order (EO) 14265, “Modernizing Defense Acquisitions and Spurring Innovation in the Defense Industrial Base,” and an overhaul of the Foreign Military Sales system to ensure we are rapidly delivering capabilities for our Warfighters and allies and partners.

U.S. Department of War: Reforming the Joint Requirements Process to Accelerate Fielding of Warfighting Capabilities
Rebuilding our military and establishing credible deterrence require the Department to field new technology and capabilities faster. To help achieve these goals, Executive Order 14265, “Modernizing Defense Acquisitions and Spurring Innovation in the Defense Industrial Base,” directs the Office of the Secretary of War, in coordination with the Secretaries of the Military Departments, and the Joint Chiefs of Staff, to complete a comprehensive review of the Joint Capabilities Integration and Development System (JCIDS) with the goal of streamlining and accelerating acquisition. The review is complete and this memorandum directs a significant reform of DoW’s process for joint requirements determination.

Transforming the Defense Acquisition System into the Warfighting Acquisition System to Accelerate Fielding of Urgently Needed Capabilities to Our Warriors
Rebuilding our military and reestablishing credible deterrence demands the Department of War (DoW) put our Acquisition System and Enterprise on a wartime footing and dramatically accelerate the fielding of new technology and advanced capabilities to maintain the military superiority of our Armed Forces. Effective immediately, the DAS is redesignated the Warfighting Acquisition System (WAS) and will now and henceforth aggressively prioritize the timely and urgent delivery of operational capabilities to the Warfighter.

The National Defense Industrial Strategy (NDIS)
With the publication of the 2022 National Defense Strategy (NDS), Secretary Austin charted the Defense Department’s way forward through today’s “decisive decade.” Taking its lead from the NDS, this first-ever National Defense Industrial Strategy (NDIS) will catalyze generational change from the existing defense industrial base to a more robust, resilient, and dynamic modernized defense industrial ecosystem.
Following the National Defense Industrial Strategy (NDIS), the OASD(IBP) released the National Defense Industrial Strategy Implementation Plan (NDIS-IP), which outlines a comprehensive plan that aligns with the strategic vision of the NDIS by both addressing consequential risks in critical areas and presenting six key DoD leader-driven initiatives to mitigate the risks and shift the strategy from vision to a fortified reality.

DARPA Expedited Research Implementation Series (ERIS)
The Defense Advanced Research Projects Agency (DARPA) in conjunction with its marketplace manager, The Applied Research Institute (ARI), is initiating a long-term, open call for new and novel technology solutions to support DARPA in advancing research, development, prototyping, experimentation, and adoption of disruptive, DARPA-relevant research and technology solutions. Specifically, DARPA seeks to obtain solutions or capabilities that deliver breakthrough technological advancements that are new as of the date of submission; or technologies, processes, research or methods that represent a new application as of the date of submission. This initiative, entitled the “Expedited Research Implementation Series” will solicit, collect, assess, and curate the most disruptive, revolutionary solutions, and make those solutions available through rapid acquisition pathways.

One of our Nation’s bedrock principles is that all Americans must be treated equally. Not only is discrimination based on protected characteristics illegal under federal law, but it is also dangerous, demeaning, and immoral. Yet in recent years, the federal government has turned a blind eye toward, or even encouraged, various discriminatory practices, seemingly because of their purportedly benign labels, objectives, or intentions. No longer. Going forward, the federal government will not stand by while recipients of federal funds engage in discrimination.

U.S. Army Corps of Engineers Digital Library Submittal playbook
In collaboration with AGC of America, the U.S. Army Corps of Engineers (USACE) published its first-ever Submittal Playbook. While not mandatory on USACE projects, the purpose of this playbook is to foster mutual understanding, share best practices, and offer practical solutions that help both contractors and government agencies streamline and improve the efficiency of the submittal process. The Submittal Playbook comes on the heels of publication of the Construction Partnering Playbook, which details for how USACE should implement partnering. The partnering playbook provides several examples and draft templates on a host of issues relevant to AGC members. Additional AGC and USACE collaboration include the Contract Changes Playbook for firm fixed price contracts. The Contract Changes Playbook was initiated based on the analysis of the USACE-AGC Joint Study on Construction Contract Modifications. The Contract Changes Playbook provides best practices, offers transparency into challenges and obstacles, and drive accountability for timely resolution of change orders. Winning the Race: America’s AI Action Plan
On July 23, 2025, President Donald Trump released America’s AI Action Plan (the Action Plan), a policy document setting forth the administration’s AI priorities. The Action Plan outlines a wide range of recommended agency actions organized around three pillars: (1) Accelerate AI Innovation; (2) Build American AI Infrastructure; and (3) Lead in International AI Diplomacy and Security. On the same day, President Trump signed three related executive orders: (1) “Preventing Woke AI in the Federal Government,” (2) “Accelerating Federal Permitting of Data Center Infrastructure,” and (3) “Promoting the Export of the American AI Technology Stack.”
